Kathmandu: Although the Supreme Court declared the government in Koshi Province led by Uddav Thapa as unconstitutional, it didn’t give a mandate to Hikmat Karki for the formation of a new government.

This raised the question: 'Who will have acting rights until the formation of the new government now?'

Therefore, Nepal Views asked Dr. Bhimarjun Acharya the same question. He answered the question in 3 points.

  1. The government led by Uddav Thapa was unconstitutional, it was not a government at all. All those processes were unconstitutional.
  2. The Constitution of Nepal has not imagined the vacuum of the government. In such cases, the Hikmat Karki-led government would get the continuation.
  3. According to Clause 2 of Article 168 of the Constitution, one week has been allotted for the formation of a united government. Let's see whether the government will be formed or not. There is a probability of the province going towards the Mid-Term election.
